So Tuesday my wife went home to see her mom and friends down there. Wednesday she calls me at work and said she got in a little humdinger. She was driving through a parking lot and some guy backed out and side swiped the side of my Monte Carlo..... Luckily the guy stopped, and he even had insurance!

Kind of interesting the cops wouldn't come file a report on it because it was on private property. Never heard of that before. So does that mean if I shoot someone in my back yard they won't come out for that either since it is private property? [S

The upside to the story is that that was where the only rust spot was on the whole car. Guess I get that fixed now free of charge!

Yep. Parking lots are the wild west. You,re a glass half full kinda guy. I was afraid the pics were gonna be ugly - that looks fixable.
 
Want to trade damage? Lol I got hit Saturday. Junked my trailer and tore the truck up pretty good.

The other driver was passed out and slumped over when she hit us. When I ran over to check on her she waved me off and told me to go away. She accidentally rolled a window down and the emts gained entry into the vehicle that way. They was getting ready to bust a window out. One EMT said they think she had a diabetic seizure but her sister talked her into refusing medical treatment and they left the accident scene.

Her insurance company isn't in any hurry to settle either.
 
the body of motor vehicle code is built upon the operation on a public highway being a privilege.
way back when...when the states were first trying to regulate driving the laws kept getting shot down by the supreme court on the grounds driving is a right and there's another supreme court decision that it's unlawful to outlaw a right for the ourpose of regulating it as a privilege.

The compromise they found was that while it remains a right to own and operate a vehicle it was deemed to be a privilege to do so on a public highway.
So you need a license and registration and have to signal your turns and can't drive drunk...on public property... or on a public right-of-way on private property.

If the property owner has an agreement with the police department to police their property then it is considered a public right of way.
If this agreement is in place then you can be ticketed for disobeying the property owner's traffic controls and be arrested for drunken driving on this private property.
The police not investigating an accident on private property wit an agreement to patrol in place would constitute a double standard.

But I don't know where this would necessarily be a motor vehicle code issue if you requested an investigation of property damage which is a criminal offense not related to motor vehicle code.
I would be a motor vehicle code issue if it involved motor vehicle code but that might not be exclusively so
the key might be in the words you use to describe the event you want investigated?
I called the cops on a trucker who hit my semi then backed in somewhere else like it didn't happen. I called the sheriff out to report property damage and hit and run instead of just a fender bender.

I had a buddy was visiting a friend at his apartment, had his keys in the bronco with the radio on it was backed in a stall at the apartment (radio was quiet) and was sitting on his friends patio drinking beer when the police came by and arrested him for operating under the influence.
The police were not called for the music there was a fight earlier in another part of the complex they had responded to.
In the trial it came out he was found guilty by the jury because it was considered a public right of way because the property owner had an agreement with the municipality to patrol the property.
so in that case I would use Jason’s DWI as precedence to sue the police for refusing to respond to an accident if I wanted to play patriot games

Where was she at?? You said down there....We are one of the few departments that still take private property accidents....funny as insurance co wants a report....kind of a catch 22 if you can't get a dept to respond...Private property accidents are actually civil matters....that's why departments decided to not take them... but we still do, just don't report them to the state and we don't issue citations to the at fault drivers....that being said, doesn't look too bad.....always a bummer to have your ride wrecked by somebody else....easier to take if it's your mistake...

Private property open to the public v Private Property..... you can drive around drunk on your butt on your own property or property of another unless said property is OPEN to the public..... an apartment parking lot is open to the public (unless otherwise posted) but is still private property...exceptions were written into the laws to cover specifically OWI / DUI due to extreme lobbying by MADD and other groups.....hench the .08 down from 1.0.....
The accident that occurs on Private land even if open to the public is considered a Civil matter and did not occur on the streets or highways of the city, township or village.....so officers are not required to report those type accidents..... we do as a courtesy to our citizens and visitors....but we also advise them that we do not cite parties for violations nor do we report them to the state...... No games......the laws dictate our actions.....

When I say down there, I am referring to Central Ohio, more specifically this happened in Bucyrus, Ohio. She grew up in a little town called Nevada, OH and I in a town called Tiro, OH. We were introduced in a town called Bucyrus which is where all the kool kids went to hang out on the weekends. Consequently that is where all her friends still live (most of mine moved away). So when she gets a couple days off she usually drives down there to hang out with friends and family

Contray to popular belief...not all cops like donuts.....:D Besides.....what if they don't have a donut shop in town.....??? Where they at the Subway??? Not as funny being at the subway......is it??? LOL
 
I love donuts and always wanted to be a cop except that criminals also carry guns. Hope you guys get your autos repaired.
 
I always say you have to drive for everyone out there. Situational awareness in every direction and just like when you ride a cycle, expect everyone to try and kill you because a few will.
 
I hate parking lots at shopping centers, they are made for sub compact cars any more and backing out is like demolishion derby time. A few months ago I had the first accident I have had in 50 years. I was backing up and so was the guy parked across the aisle, we backed into each other. I had a couple of scratches on my Caddy but his Lexus folded like a $2.00 suit. Luckily, we both have Geico, so it was an easy claim. I didn't even want anything done on mine, but he sure needed repairs on his.

Don, you should live around here where half the people drive 4 door duallys and try to squeeze them into those spaces. Or even worse yet is that a bunch of them never unhook the goose neck stock trailer and still try to get as close to the front door as they can.
My first wife used to get mad because I'd go about 6 spaces past the last car just so I didn't get doored. ALL of us Americans are so dam lazy we won't walk an extra 100 feet to park out at the end. Cabella's is about the only big parking lot I see, don't do Mal-Wart, Lowe's, Home Depot, Target or any mall.
