Drinking and driving is negligent. Pure and simple. You knowingly and willingly put lives at risk. You also do that when you speed excessively...or talk/text on your phone....just sayin'.... there's more than one way to kill people with a car. Ask a bloodsucking lawyer. :rolleyes:

Home invasion: Many years back, a friend's uncle pistol-whipped a "kid" who broke into his house. The kid got a trip to the ER, a slap on the wrist and probation for B&E. The old man faced the more serious charges of "assault causing bodily harm" and "assault with a deadly weapon". Again, enter the lawyer and the kid has "rights". Give me a break. He should have shot him dead...free of charge!

When I was 17 living in Denver, CO the big news at one time was a warehouse owner that got tired of his place getting broke into. So he rigged the door that was always getting smashed down with a shotgun. After a month, 2 18 year olds broke down the door, one was killed the other went to the ER and lived. the DA hung him on the fact that if the fire department had responded to a fire at his warehouse and had gone through that door that could of been a fireman that was killed. He got charged and sued for wrongful death.
 
Michigan put the No retreat into law a while back...

prior you had an obligation to get the heck away if threatened....not anymore.....and the number of cpl's (concealed pistol licenses) and hand gun purchases has gone up dramatically in the last few years......

Doc....I wasn't trying to excuse their actions....there is the intent of the law and the letter of the law....our legal system sucks and so do the deterents to crime and or DUI......here we call it OWI..I know the alcoholics that drink and drive reek havoc and kill innocents, but there is a difference between them and a career criminal / repeat offender / homicidal psychopath....even if only slightly....having seen both types of these deaths... neither is acceptable nor warranted..........
 
if everyone carried daily and there was more of a presence of law abiding citizens all these ***** gangsters would think twice about throwing down on someone. If they think that they could be wearing some ****ing lead this ******** would stop!

Yeah, I got that and I agree. I was trying to demonstrate how lawyers twist legal terms and definitions, usually with results that don't make sense.

Lawyers.....was just in court with one defense attorney that was unusually obnoxious...... I was there to substantiate the Data Master breath test machine and our weekly calibration.... he must have asked me the same question 5 times about the ampules we use that contain the alcohol solution we mix with distilled water and the lot numbers of each...after the last time I was miffed and stated "you asked me that several times, I've answered it each time"... he asked the judge to please direct the witness to answer the question and that I was being "arguementative"..... the judge said "Mr. Lewis, the witness has answered that question at least five times....do you have any further questions of this witness? If not, I suggest we move on." Even the jury was snickering.....He simply said, "no your honor" and sat down...
The jury found the guy guilty of Felony drunk driving.....:D

You just can't do that anywhere. People who have and it got the perp, always end up sued or in way more trouble than the bad guy. And it's against the law to use lethal methods to protect property when no threat to humans is involved. Bad idea.
 
I am a fan of making my own justice for this sort of thing. Recently signed up for a class for concealed carry, my gun that I am going to carry is a Taurus judge loaded with buckshot..... I refuse to be a victim. Picked up a LCP for her. She also is planning to take the class.

Down here in Florida we have a "Stand your ground" law that basically says if you feel threatened for your life you have the right to defend yourself by whatever means to save yourself. It is under fire right now because of the George Zimmerman case where he shot that black kid who was walking through his neighborhood.

That trial is going to be an interesting one to see how it turns out. Jesse Jackson and Al Sharpton have been here protesting the shooting. Funny, they never came when those two black kids shot the Chinese delivery guy.:rolleyes:

This is just going to be a big mess

All I see coming out of this is more gun control. The out come of someone taking the law into their own hands and not being smart.

In the min 90's there was a fire on the mountain side out side of town, you could take the back roads out of town and be within 4 miles and get a good veiw of the fire(no homes were in dangers so blm let it burn). Me, my wife and two sons both under five got in the car to go check out the fire and take some pictures. We drove around for about 10 minutes looking for the best place to veiw the fire.

During this time I had noticed another car that seemed to be following me, at first I paid no mind to it thinking that they were looking at the fire also. The car always stayed back a bit but always had it's brights on. So I would move up the road aways, next thing I know there would be the car. This went on for around 10 minutes so this got me to thinking maybe this guy is following me. Now I'm parked on a road that dead ends in a mile the wife is getting scared and this car is not giving up.

Now the car is about 30 yards behind me and I'm coming up to a spot in the road at has a wide sholder large enough to do a fast turn around. I gave my with the cell and told her to call 911 if the other car gave chase. I slowed down be shifting into low not using the breaks, turn off onto the sholder flipped a u-turn hit the brights punched the gas and shot past the car, Passing the car I could see the person in the passenger seat had a gun planed down on my car.

The car hits the breaks flips around and gives chase. I'm 15 minutes out on back roads being chased. My wife calls 911, she is freaking out can't talk. I'm burning down the road at 75 mph on the cell giving My location to the officer. This is all happening fast a couple seconds later the officer said Mr ------- I believe we have the person chasing you on the other line he is going to flash his lights 5 time please flash your breaks 5 times after him so we can have conformation it is you two. All went as planed and the officer asked me to pull over and stay on the line and the other guy would be pulling in behind me to get this sorted out. after a couple minute things calm down and no one is going to get shot I hung up got out and talked to the guy.

Come to find out there had been alot of things stolen in the area the last couple weeks. Had one of us not been level headed, someone could of been killed that night. And if I had a gun and no cell, that night some one would of been killed. I'm not against gun permits, I'm against the wrong people having permits.

Just food for thought.

They never said a word about this torture and murder of 2 white kids by 5 blacks.

here is a snippet from that report. Had these young whites had a gun things might have been a lot different. This case never even made national news it was all kept hush hush.

"Christian and Newsom had gone on a date at a local restaurant on Saturday, January 6, 2007, but did not return home. During their night out, the couple were carjacked, bound and blindfolded by three men and taken to Lemaricus Devall 'Slim' Davidson's rented house on Chipman Street."[5]

Christian's parents found her abandoned Toyota 4-Runner two blocks away from the Chipman Street house the following Monday with the help of her mobile phone provider. An envelope recovered from the vehicle yielded fingerprint evidence that led police to Lemaricus Davidson and 2316 Chipman Street. When police went to the address on Tuesday, January 9, they found the house unoccupied and Christian's body in a bin in the kitchen.

According to the testimony of the Knox County Acting Medical Examiner Dr. Darinka Mileusnic-Polchan at the subsequent trial of Eric Boyd, Newsom was repeatedly sodomized with an object and then blindfolded, gagged, arms and feet bound and his head covered. Barefoot, he was dragged outside the house to a set of nearby railroad tracks. He was shot in the back of his head, neck and back and his body was then set on fire.

According to the testimony of the medical examiner, Channon's death came after hours of torture, having suffered injuries to her vagina, anus and mouth. She was raped with an unidentified object and beaten in the head. It was also reported that her body was scrubbed with bleach which was also poured down her throat, in an attempt by her attackers to remove DNA evidence, while Channon was still alive. She was then bound with curtains and strips of bedding, her face covered with a bin liner and her body stashed within five large bin bags, before being placed inside a residential waste disposal unit and covered with sheets. The medical examiner said there was evidence that Channon slowly suffocated to death."
 
This isn't just people who made wrong decisions, this is a social ill when people are desensitized to other humans. I can't say this is carved in stone but look at what people pour into theirs heads. Do you know how many thousands of hours of violence the average 18 year old has been exposed to? How many of us watch murder and crime shows on tv and think nothing of it, or play violent video games? What you pour into your head is what's in there and if you think there is nothing wrong with watching movies where people hurt people or playing video games that have you vaporizing other humanoids, then you yourself might be part of the problem. I mean look how many of us just pull up our John Wayne pants and the first thing we think of is kill the bastads. Using more violence to settle violence just somehow seems a little out of balance. No I don't have the answers but I do know that each one of us is part of this society and if it's ill, we probably need to take a good look at ourselves too..

We tried giving them a "time out" but they keep getting up out of the corner. ;)

The advantage of corporal punishment,whether its a belt or a noose is the deterant factor.When I was growing up I knew without a doubt what the consequences where if I made a poor choice.Yes on several occasions as a child I tested the system and it flawlessly administered punishment.Now as an adult I do know right from wrong,work from lazy and that easiest way is not always the best.
Im not against passive control if it works, but in most cases if there is no deterant just moral deterant then it tends to break down.

And this is the biggest thing lacking today. I have two boys now 21 (2 months ago) and 23. Real hard cases, I always had to deal with thier gangbanging uncles preaching the ways of so called real life. Topped off with 8 years of working out of town. Being home 1 1/2 days a week and trying to undo 5 days of BS is no picnic.

Now I'm the so called bad guy in my family because your right or wrong, no gray area. If you are messing up then you have a problem and it is gotting to be dealt with and done right. Both of my boys grew up hating me, not because I was beating them (of coarse a swat to them is beating them) but because they were not going to rule the house and do what they pleased. I would do things like disconnect the power in thier rooms. Cut the plugs off of tvs and games. Remove thier doors and take 2 weeks to paint them. Block the phone, cable and internet.

Thing where always tence in the house but never had to go past me having to hold one down till the cops showed up. Adding to the hating me more, but oh well. We did have a coming to god about 6 months ago when the two boys thought they could tag team me. I think what hurt them the most was with all the fists flying not one was mine and I was able to take both to the ground and wait for the cops. The plus out of all this is when they start getting out of hand I tell then to knock off the crap and it is done. They know they can't take the old man now and they don't hate me as bad as they use to.

There is still a long ruff road ahead for the two boys but now they are starting to understand that, in the end you are going to pay for making bad choices.
